TERMS AND CONDITIONS GOVERNING RHB MOBILE APPLICATION

 

INTRODUCTION

The RHB mobile software application is brought to you by RHB BANK BERHAD, a company incorporated in Malaysia, through its Singapore Branch (UEN: S99FC5710J).

These terms and conditions (“Terms”) will apply to your use of the RHB Mobile software application. Additional terms and conditions will apply or may be prescribed by the Bank from time to time in respect of certain accounts and services and shall be read together with these Terms and shall be considered as an integral part of these Terms in relation to the specific services or accounts.

Please take the time to read and understand these Terms (including all agreements and Policies referenced herein) before using our services so that you are aware of your legal rights and obligations.

By using the RHB mobile software application, you are entering into a binding contract with us and shall be deemed to have expressly read, understood and agreed to be bound by these Terms, as may be amended by us from time to time.

 

1. DEFINITIONS
In these Terms and Conditions:
1.1   Residents of Singapore are persons who are:
 
a.   Citizens of Singapore;
b. Considered as Singapore resident under the Singapore Income Tax Act; or
c.  Permanent residents of Singapore;
1.2 “You” refers to the person who download and use the RHB Mobile software Application and the RHB FX Multi-Currency service;
1.3 “THE BANK”, ‘we’, ‘us’ refers to RHB Bank Berhad, Singapore Branch.

 

2.    RHB MOBILE SOFTWARE REGISTRATION AND ELIGIBILTY
To download and or use the RHB Mobile Software Application, you must ensure that you meet the following eligibility criteria:
 
a.   You must be 18 years and above and have the legal capacity to enter into a legally binding agreement/contract;
b. You are not a bankrupt;
c. There are no bankruptcy proceedings pending or threatened against you;
And in relation to the use of the RHB FX Multi-currency card you are required to have
 
d.   A residential address in Singapore or Malaysia;

 

3. RHB MOBILE SOFTWARE APPLICATION
The RHB Mobile software application allows you to perform the following:
3.1  In relation to the RHB FX Multi-Currency card:
 
i. Apply for the RHB FX Multi-Currency card;
ii. Check your available balance in the RHB FX Multi-Currency card;
iii. Make a top up to your wallet on the RHB FX Multi-Currency card;
iv. Transferring value between wallets on your RHB FX Multi-Currency card,
v. Locate an overseas ATM;
vi. Change your personal details for your RHB FX Multi-Currency card;
vii. Lock lost or damage RHB FX Multi-Currency card; viii.Enable card for locked RHB FX Multi-Currency card;
ix. Enable overseas magstripe use;
x. Request a replacement RHB FX Multi-Currency card to be send to you;
xi. Set card limits for the RHB FX Multi-Currency card; xii.Turn on App or Transaction notification;
xiii. Manage or set currency alert;
xiv.   You can check your Transaction history for your RHB FX Multi-Currency card. The transactions history will be kept for a period of 3 months.
3.2   In relation to the RHB Mobile banking services:
 
i.     You can open an account with RHB Bank;
ii. You can view your transaction history for your RHB accounts (RHB Savings and RHB Current account);
iii. Transfer wallet money from RHB account(s) to your RHB FX Multi-currency card;
iv. Transfer money between your RHB accounts maintained with RHB Bank Berhad Singapore branches;
v. Transfer money from your RHB accounts to any other banks in Singapore;
vi. Any other services that are made available from time to time under the RHB mobile software application. Please refer to the Bank’s terms and conditions in relation to electronic payment transaction that is available at www.rhbgroup.com.sg which applies in relation to transactions made using the RHB mobile software application.

 

4. FEES AND CHARGES
4.1   Please refer to the Fees and Charges that applies for the use of the RHB Mobile software application and the RHB FX Multi-currency service which is available at www.rhbgroup.com.sg/others/forms-and-faq/rates-and-charges.
4.2 The fees and charges are subject to change from time to time. There are other fees and charges imposed by the Bank for transactions and instructions made for any other services (including bank charges, administrative charges, processing fees, interest charges, etc.).
4.3 Please be reminded that the Bank has the right to automatically debit your account(s) for all fees and charges imposed by the Bank and any governmental fees, taxes and or levies, and also any other fees and charges payable on the transactions performed by you from time to time. No separate notice to you will be given in relation to any debiting made by the Bank for the payment of the fees and charges.

 

5. RHB FX MULTI-CURRENCY FOREIGN EXCHANGE (FX) SERVICE
5.1 By using the RHB FX Multi-Currency service, you agree to the following additional terms and conditions:
5.1.1 You acknowledge that there are risks associated with FX transactions. The FX transactions executed via the RHB FX Multi-Currency service are made at your own discretion and risk.
5.1.2 RHB Bank does not provide any advice of any kind and does not act as your advisor or agent or in any fiduciary capacity in the FX transactions. You should seek advice from an independent financial advisor if you have any doubts in relation to the FX transactions.
5.1.3 The rates quoted via RHB FX Multi-Currency service are only applicable via the RHB mobile software application.
5.1.4 The FX rates quoted in the RHB FX Multi-Currency mobile software application is only valid at or for the relevant time quoted in the mobile application. The rates provided are indicative only. The foreign currency trade transaction will be executed only when the Bank accepts the trade and subject to you having sufficient funds in your Multi-Currency card e-wallet to complete the trade.
5.1.5 The Bank reserves the right to reject any FX trade transactions requested by you without giving any reason and without any liability for any loss or damage incurred by you;
5.1.6 All FX trade orders made cannot be cancelled;
5.1.7   In the event of erroneous transactions resulting from specific market circumstance or system malfunctions or manipulations, the Bank reserves the rights to cancel, rescind or modify such error.

 

6. MOBILE BANKING SECURITY PROCEDURES.
6.1 By using RHB Mobile Banking Services, you agree to comply with the security procedures set forth in this Section. You are solely responsible for maintaining the security of your Mobile Device and for any unauthorized use of your Mobile Device to access the Mobile Banking Services. You agree to lock your Mobile Device with a password or number code whenever it is not in use so that your personal information is not accessible by others. You agree to notify us immediately in the event you become aware of any loss, theft, or unauthorized use of your Mobile Device. SMS or text messages you send or receive in connection with the Mobile Banking Services may not be secure. While we attempt to mitigate the risk of fraud, we do not warrant that a third party will not intercept text messages used in connection with Mobile Banking Services. You agree that you will not send us any sensitive or confidential account information via SMS (or text) message.
6.2   Once you have sent transaction instructions to us via the Mobile Banking Services, you will not be able to reverse or “undo” those instructions. It is your responsibility to correctly enter all transaction information into your Mobile Device, including transaction amounts. Our Mobile Banking Services and any software you may obtain from Mobile Banking ("Software") may not be available from time to time, including, without limitation, scheduled maintenance or interruption in Internet service.

 

7. BIOMETRIC LOGIN
7.1 Biometric login is an optional sign-in method that may be available for certain mobile devices that have a built-in biometric scanner in lieu of your RHB Mobile username and password as security code to confirm your identity to access the Bank’s mobile banking services.
7.2 To use biometric login, you will need to first save your biometrics on your mobile device. Biometrics are stored on your device only and RHB never sees or stores your biometric information.
7.3 You will need to activate the biometric function on your mobile device and register your biometrics to control access to the mobile device;
7.4 You may activate biometric authentication after logging in to RHB Mobile. Upon the successful activation, the biometric identification stored on your mobile device can be used to perform logins and authenticate transactions on RHB Mobile.
7.5 You understand that upon the successful registration of your mobile device, any biometric identification that is stored on your mobile device can be used to access mobile banking services including access to your accounts.
7.6 You should ensure the security of the security codes as well as the password or code that you can use to register your biometric identification on the mobile device.
7.7 You may still choose to access the mobile app using your RHB Mobile PIN.
7.8 Biometric information of other users stored in a mobile phone may be used to access your RHB Mobile account on the device. You may choose not to activate biometric authentication on RHB Mobile if your device has the biometric information of multiple users.
7.9 Each time the mobile app detects the use of a biometric identification registered on a mobile device on which you have registered for the RHB biometric login service to access our mobile banking services or authorise transactions, you are deemed to have accessed the mobile banking services and/or instructed us to perform such transactions as the case may be.
7.10 You acknowledge that the authentication is performed by the mobile app by interfacing with the biometric identification authentication module on the mobile device and that you agree to the authentication process.
7.11 You can deactivate the RHB biometric login service at any time once you are signed in.
7.12 If you inform us that the security of your biometric identification or other security code has been compromised, we may require you to change the security code, re-register your biometric identification or cease the use of the RHB biometric login service.
7.13 You acknowledge and agree that, for the purposes of the RHB biometric login service, the mobile app will be accessing the biometric identification registered in your mobile device, and you hereby consent to the Bank accessing and using such information for the provision of the RHB biometric login service.
7.14 You understand the need to protect your mobile device and shall be responsible for all use of your mobile device (whether authorised by you or otherwise) to access the RHB biometric login service.
7.15 In addition to and without subtracting the disclaimers and exclusions of liability herein:
7.15.1 You understand that the biometric authentication module of the mobile device is not provided by the Bank, and we make no representation or warranty as to the security of the biometric authentication function of any mobile device and whether it works in the way that the manufacturer of the device represents.
7.15.2 We do not represent or warrant that the RHB biometric login service will be accessible at all times, or function with any electronic equipment, software, infrastructure or other electronic banking services that we may offer from time to time.
7.15.3 Unless a law prohibits us from excluding or limiting our liability, we are not liable for any loss you incur in connection with the use or attempted use of the RHB biometric login service, or your instructions, or any unauthorised transactions through or in connection with the RHB biometric login service.
7.15.4   You shall indemnify us from all loss and damage which we may incur in connection with any improper use of the RHB biometric login service.

 

8. SOFTWARE TOKEN AND AUTO ONE TIME PASSWORD (OTP) ON THE RHB MOBILE
APP After your registration to access the RHB Mobile App is completed, you will need to log in for the first time using your username and password. You will then be prompted to key in your 6-digit PIN that will be used for subsequent logins. The App will also request for you to activate your Software Token by keying in the One-Time Password (OTP) that is sent to your registered phone number with the bank. By activating the Software Token, you will be able to authorise transactions on RHB Mobile using your 6-digit PIN.
8.1 For any transaction on mobile banking that requires 2-Factor Authentication, you will need to key in your 6-digit PIN or use biometric authentication if it is enabled on your phone. 2-Factor Authentication can only be performed after you have activated the Software Token on RHB Mobile.
8.2 Auto OTP requires you to register for this service and by doing so you acknowledge and agree that you are a registered and valid user of our mobile banking services.
8.3 Each time your 6-digit PIN is keyed in on the Device for 2-Factor Authentication, you are deemed to have accessed mobile banking and/or instructed us to authenticate the session.
8.4 If you inform us that the security of your mobile app or other security code has been compromised, we may require you to change your password and PIN number.
8.5 In addition to the disclaimers:
8.5.1 We do not represent or warrant that Auto OTP will be accessible at all times, or function with any electronic equipment, software, infrastructure or other electronic banking services that we may offer from time to time.
8.5.2  Unless a law prohibits us from excluding or limiting our liability, we are not liable for any loss you incur in connection with the use or attempted use of Auto OTP, or your instructions, or any unauthorised transactions through or in connection with Auto OTP.

 

9.    RESTRICTION ON USE
You agree not to use the Mobile Banking Services or the Software in or for any illegal, fraudulent, unauthorized or improper manner or purpose and agree that such Mobile Banking Services and Software will only be used in compliance with all applicable laws, rules and regulations, including international Internet, data, telecommunications, telemarketing laws and regulations.

 

10. INTELLECTUAL PROPERTY
10.1 All intellectual property and all materials comprising or contained in the RHB mobile software application including but not limited to text/articles, logos, software and images are owned by or as the case may be licensed to the Bank.
10.2   You are entitled to access the website or download the application for purpose of using the services offered by us. However, you may not use in anyway, directly or indirectly the website or the applications or any of its components for any other purpose. The materials contained or comprising the website or applications may not be copied or redistributed without the prior written approval of the Bank.

 

11. LINKS TO OTHER SITE(S)
11.1   The application may contain links to third-party website. Such links are provided to you for your convenience only.
11.2 The Bank has no control over any material which has been published or contained on such third-party websites.

 

12. PRIVACY AND DATA PROTECTION
12.1 RHB Privacy Policy, as may be amended, supplemented and/or substituted from time to time, is incorporated by reference into and forms part of these Terms and Conditions and shall apply to all personal data that you provide to us or that we have obtained from any other sources or that arises from your relationship with us or any other RHB Entity and our Affiliates. The RHB Privacy Policy is available at www.rhbgroup.com.sg/others/general-info/privacy-notice.
12.2 You hereby consent to our collection, use, disclosure and processing of your personal data in accordance with the RHB Privacy Policy and these Terms and Conditions.
12.3 If you provide us with the personal data of any individual (other than your own, if you yourself), you hereby consent on behalf of that individual whose personal data you provide, to our collection, use, disclosure and processing of his/her personal data in accordance with the RHB Privacy Policy and these Terms and Conditions. You warrant that you have obtained that individual’s prior consent to such collection, use, disclosure and processing of his/her personal data by us and that the personal data that you provide to us is true, accurate and complete.
12.4 Any consent you give pursuant to these Terms and Conditions in relation to personal data shall survive your death, incapacity, bankruptcy or insolvency, as the case may be, and the termination of these Terms and Conditions and, where applicable, the closure of your Account.

13. DISCLAIMER AND LIMITATION OF LIABILITY
13.1 The RHB mobile application and the related services provided under the mobile application are provided as is without warranty of any kind, either express or implied and in particular we do not guarantee continuous, uninterrupted access to any part of our service and the operation of the mobile application may be interfered with by numerous factors outside of our control.
13.2   YOU ACKNOWLEDGE AND AGREE THAT FROM TIME TO TIME, THE MOBILE APP AND THE SERVICES MAY BE DELAYED, INTERRUPTED OR DISRUPTED FOR AN INDETERMINATE AMOUNT OF TIME DUE TO CIRCUMSTANCES BEYOND OUR REASONABLE CONTROL, INCLUDING BUT NOT LIMITED TO ANY INTERRUPTION, DISRUPTION OR FAILURE IN THE PROVISION OF THE SERVICES, WHETHER CAUSED BY STRIKES, POWER FAILURES, EQUIPMENT MALFUNCTIONS, INTERNET DISRUPTION OR OTHER REASONS. IN NO EVENT SHALL WE OR OUR AFFILIATES OR LICENSORS OR CONTRACTORS OR THE EMPLOYEES OR CONTRACTORS OF ANY OF THESE, BE LIABLE FOR ANY CLAIM ARISING FROM OR RELATED TO THE SERVICES THAT IS CAUSED BY OR ARISES OUT OF ANY SUCH DELAY, INTERRUPTION, DISRUPTION OR SIMILAR FAILURE. IN NO EVENT SHALL WE OR OUR AFFILIATES OR LICENSORS OR CONTRACTORS OR THE EMPLOYEES OR CONTRACTORS OF ANY OF THESE, BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, OR LOSS OF GOODWILL OR LOST PROFITS (EVEN IF ADVISED OF THE POSSIBILITY THEREOF) ARISING IN ANY WAY OUT OF THE USE, OR MAINTENANCE OF THE MOBILE APP, OR THE SERVICES, EVEN IF SUCH DAMAGES WERE REASONABLY FORESEEABLE AND NOTICE WAS GIVEN REGARDING THEM. THESE LIMITATIONS WILL APPLY TO ALL CAUSES OF ACTION, WHETHER ARISING FROM BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER LEGAL THEORY.

 

14. GOVERNING LAW AND JURISDICTION
14.1 These terms and conditions shall be governed by and construed in accordance with the laws of Singapore and the customer irrevocably submits to the non-exclusive jurisdiction of the Courts of Singapore.
14.2   The Bank shall not be responsible for the effect of any laws, regulations, governmental measures or restrictions or any relevant country which may be applicable to any multi-currency account and the customer accept all risks of or arising from any such laws, regulations, governmental measures and restrictions.

 

15.      SEVERANCE
If any of the terms herein shall be void or illegal or unenforceable then the same be deemed to have been severed from the other terms with such consequential amendments, if necessary and the other terms shall otherwise remain in full force and effect.

 

16.      AMENDMENTS
The Bank reserves the right from time to time to make such further terms and conditions or amend, vary or modify the terms and conditions herein at the Bank’s absolute discretion. The amendments and changes may be made known by the Bank by publication in any form or media, including through the Bank’s website, displaying notice thereof in the Bank’s premises or by posting the notice thereof by ordinary mail to the customer and the customer shall be bound by such amendments and changes to these terms and conditions from the date of such notice. Upon such display or posting of the notice, the customer is deemed to have actual notice of the amended Terms and Conditions. If the customer does not accept the amended Terms and Conditions, the customer shall discontinue operating the account and shall promptly close the account. If the customer continues to operate the account after such notification, the customer shall be deemed to have agreed to the addition and/or variation without reservation.

 

17.      ENGLISH VERSION TO PREVAIL
If there are differences in meaning between the English version and any translation of these terms and conditions, the English version shall prevail.

 

18.      ADDITIONAL TERMS AND CONDITIONS ON VISA GLOBAL ATM LOCATOR

The ATM Locator Service Information is the copyrighted property of Visa and its licensors, and is sub-licensed pursuant to a license from Visa for limited, non-exclusive use.

The ATM Locator Service Information may not be copied, reproduced, republished, uploaded, posted, transmitted, stored or distributed in any way, except that user may download one listing (a location's name and address) on an individual non-automated basis per visiting session to the user's personal and non-commercial use, provided that such personal and non-commercial use shall not include sharing by user with other end-users, nor may it be copied, reproduced, republished, uploaded, posted, transmitted, stored or distributed in any way.

User may not use any ATM Locator Service Information for the purpose of compiling, enhancing, verifying, supplementing, or otherwise modifying databases, lists, or directories of any kind, including, but not limited to, location databases, mailing lists, contact lists, marketing lists, geographical directories, or any other compilation or collation of information which is sold, rented, published, distributed or in any manner supplied to a third party.

There is no warranty that any of the ATM Locator Service Information or any other information or service provided or referenced by this site is either merchantable or accurate. The ATM Locator Service Information and all other information and services provided or referenced on this site are provided "as is" and with all faults. Your use of the Visa ATM Locator Service Information is at your own risk.

While Visa uses reasonable efforts to include accurate and up-to-date information for the Visa ATM Locator Service Information, Visa makes no warranties or representations as to its accuracy. Visa assumes no liability or responsibility for any errors or omissions in the content of the Visa ATM Locator Service Information.

Deposit Insurance Scheme
Singapore Dollar deposits of non-bank depositors are insured by the Singapore Deposit Insurance Corporation, for up to S$75,000 in aggregate per depositor per Schem member by law.
